Bankruptcy

There are two types of personal bankruptcy: Chapter 7 and Chapter 13. Chapter 7 erases all debts that are legally capable of discharge. Chapter 13 bankruptcy reorganizes debt into a repayment plan over a period of three to five years. If you qualify for Chapter 7 bankruptcy, this can be a very effective method of debt relief. Debt settlement companies (aka debt negotiation companies) are professional negotiators that can settle your debts for a fraction of what you owe. Be careful of who you work with, however. Make sure they are FTC compliant and an member of either TASC (The Association of Settlement Companies) or USOBA (United States Organization for Bankruptcy Alternatives). Credit Counseling

If you have just gotten a little behind on your debts and need some help with your monthly payments and interest rates, credit counseling may be right for you. Most credit counseling programs have pre-negotiated terms with credit card issuers that allow for interest rate reductions and an accelerated pay-off period. Debt Consolidation

Debt consolidation programs come in three forms:

  1. A secured loan, (like a home equity or home improvement loan) taken out to pay off your smaller accounts,
  2. An unsecured loan, such as a signature loan from a bank, or a new credit card, and
  3. Debt management programs offered by credit counseling companies.

With option #1 above, you are transforming unsecured debt into secured debt and therefore will enjoy the best rates. With option #2, you will likely reduce your rates if you shop around for the right offer. With option #3, you aren't technically consolidating your debt, but you enjoy the convenience of paying a single company at reduced rates. Debt Restructure

Debt Restructure allows you to purchase your qualifying debt back from creditors for 40 cents on the dollar on a payment plan. Since most debt settlements require lump sum payments, debt restructure groups use "friendly creditors" to purchase your qualifying debt and finance your 40% settlement over a period of 2-4 years.
